These terms cover billing, acceptable use, AI content accuracy, data ownership, and liability between you and Analytics Lab S.R.L., the Romanian company that operates Kustiq.

§1Agreement

By accessing or using Kustiq (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.

Kustiq is operated by Analytics Lab S.R.L., a Romanian limited liability company.

These Terms, together with the Privacy Policy and Data Processing Agreement, form the complete agreement between you and Analytics Lab S.R.L. regarding the Service.

§2Eligibility

The Service is for business use. By creating an account you confirm three things.

You are 18 or olderYou sign up on behalf of a business or yourself as a sole traderYou are not in a sanctioned jurisdiction

Sanctioned jurisdictions are the EU and OFAC consolidated lists in force at the time of signup. We block accounts originating from those regions automatically and reserve the right to terminate any account we later identify as ineligible. Consumer use is not supported. The Service is not directed at children, and we do not knowingly process personal data of anyone under 18.

§3Service description

Kustiq is a company-intelligence platform for B2B teams. It generates company profiles from publicly available web data and includes a Targeted Outreach pipeline, churn-risk scoring, churn prediction, and related features accessible through the web application and the API.

We target 99.9% uptime for the web application and API but do not guarantee uninterrupted access. Planned maintenance windows go out by email or in-app when possible. We are not liable for temporary unavailability due to maintenance, third-party service disruptions, or circumstances outside our control.

§4Accounts and teams

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at support@kustiq.com if you suspect unauthorised access.

If you create an organisation or invite team members, the organisation owner is responsible for all activity by team members within the organisation, ensuring those members comply with these Terms, and managing permissions using the role-based access controls provided. Billing is at the organisation level. The owner or billing admin is responsible for all charges incurred, regardless of which team member initiated the usage.


§5Credit-based billing

Plain EnglishYour plan ships monthly credits that reset each cycle. Extra credits you buy separately never expire. Cancel anytime. Subscriptions are not refundable for the current period.
  • Paid plans include a monthly credit allocation. Credits reset at the start of each billing cycle. Unused monthly credits do not roll over.
  • Extra credits can be bought any time at the rates on the pricing page. Extra credits do not expire and persist across billing cycles until used.
  • Profile credits. Each profiling request consumes 1 credit per company profile.
  • Outreach credits. Targeted Outreach prospects consume ~3.0 credits across the 5 pipeline phases (Discover, Research, Qualify, Enrich, Emails). The exact total depends on how far a prospect advances before the qualifier filters it out.
  • Subscriptions are billed monthly or annually through Stripe. Upgrades take effect immediately with prorated charges. Downgrades take effect at the end of the current billing period.
  • You may cancel your subscription at any time. Your plan stays active until the end of the current billing period.
  • Refunds. Subscription fees are non-refundable for the current period except where required by applicable law. If you cancel mid-cycle, access continues through the end of your paid period. Extra credit purchases are non-refundable once credits have been delivered to your account. If a technical error on our side prevents credit delivery, or a job fails before completion, we will deliver the credits or refund them to your balance.
  • Failed payments.If a subscription payment fails, we will retry the charge up to 3 times over a 7-day period using Stripe’s automatic retry logic. During the retry window your subscription stays active. If all retries fail, your account reverts to free-plan access until payment is resolved. We will notify you by email before any access restriction takes effect. Extra credits already bought stay available regardless of subscription status.

§5a · Pricing changes

We may change subscription pricing with 30 days’ email notice to the billing contact on file. Existing annual plans hold their rate through the end of their current renewal term. Extra credit pack rates may change without prior notice but never apply retroactively to credits already purchased. The same change is mirrored on the pricing FAQ.

§6Free plan

The free plan provides 3 credits per week for signed-in accounts and 1 credit per week for anonymous use, with no time limit and no credit card required. Free-plan usage is rate-limited per IP address. We reserve the right to modify or discontinue the free plan at any time. Free-plan users can upgrade to a paid plan at any time for higher credit allocations and additional features.


§7AI-generated content

Plain EnglishProfiles are AI-generated from public web data. They are informational, not verified facts. Always validate before making business decisions.

Company profiles and intelligence generated by Kustiq are produced using a combination of deterministic data pipelines and AI language models. We invest in accuracy engineering and surface confidence scores so you can assess data quality. Profiles reflect conditions at the time of processing and should be used alongside your team’s judgement.

You acknowledge that:

  • Generated profiles are not verified facts and should be treated as a starting point for further research.
  • Profiles are produced from publicly available web data at the time of processing and may not reflect current conditions.
  • Confidence scores indicate the engine’s assessment of data quality, not a guarantee of accuracy.

AI model training. Your data is not used to train AI models. Submitted data is processed via Anthropic’s API, which contractually prohibits the use of API inputs and outputs for model training. We do not use your data to fine-tune, train, or improve any AI model. More on the Trust & Security page.

§8Acceptable use

Plain EnglishUse Kustiq for B2B research and outreach. Do not scrape consumer profiles, run spam, ship illegal content, or break the law. Abuse means a permanent ban with no refund.

You agree not to use the Service to violate any law, regulation, or third-party right. Specifically, you may not use Kustiq to enrich consumer (B2C) personal data, perform data-broker resale, send unsolicited marketing in violation of CAN-SPAM, GDPR, or local law, attempt to bypass rate limits or authentication, or reverse-engineer the Service.

We reserve the right to suspend or terminate accounts that violate this section. Repeated or material breaches result in permanent termination with no refund of remaining subscription period or unused credits. Suspected breaches are reviewed by a human; you can appeal at support@kustiq.com.

§9API access

API access is included on paid plans subject to per-plan rate limits published on the API docs page. Keys are issued per organisation and consume credits identically to web-app usage. We may rate-limit, suspend, or revoke keys that consume credits in a pattern inconsistent with normal product use. We will email the billing contact before revocation unless the pattern indicates active abuse.

§10Third-party integrations

Plain EnglishConnecting CRMs and AI providers grants only the scopes the integration screen lists. Disconnecting kills the access token within 24 hours.

HubSpot, Stripe, Anthropic, Serper, Browserless, and other named sub-processors operate under their own terms. The current list, with purposes and data flows, lives on the Trust page and in the DPA. When you connect an integration, you authorise Kustiq to push and pull only the fields the integration scope describes. Disconnecting revokes access immediately and removes stored OAuth tokens within 24 hours.


§11Intellectual property

Plain EnglishYou own your inputs and the profiles we generate for you. We own the platform, the pipeline code, and any aggregate, anonymised data we use to keep both running.

Customer data. You retain all rights to data you submit, including target lists, ICP configurations, and account notes. You grant Kustiq a worldwide, non-exclusive licence to process this data solely to provide the Service to you and your team.

Generated profiles. Profiles produced for your account are licensed to you for your internal business use. You may export, share within your organisation, and store profiles indefinitely. Reselling raw exports as a database product is not permitted.

Platform IP. The Service itself, including the pipeline code, the user interface, the brand, and any aggregate, anonymised data we derive to operate or improve the platform, remains the exclusive property of Analytics Lab S.R.L. Nothing in these Terms transfers platform IP to you.

§12Confidentiality

Plain EnglishWe keep what you submit confidential. We use it only to run the Service. Sub-processors get the minimum data needed to do their job.

Each party will protect the other’s confidential information using the same care it applies to its own confidential information of like importance, and will not disclose it to third parties except sub-processors bound by equivalent obligations. The duty survives termination for three years, except for trade secrets, which survive for as long as they remain trade secrets under applicable law.

§13Disclaimer of warranties

Plain EnglishThe Service comes “as is”. We make our best effort, but profiles are AI-generated and may be incomplete or wrong. Validate before betting commercial decisions on them.

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Analytics Lab S.R.L. disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted or error-free. Profiles, churn risk and churn prediction outputs, and outreach drafts are produced by AI pipelines and provided for informational use only; they are not legal, financial, or professional advice.

§14Limitation of liability

Plain EnglishIf something goes wrong, our maximum payout to you is what you paid Kustiq in the prior 12 months. We are not on the hook for lost revenue, lost data, or what your team did with our output.

To the maximum extent permitted by applicable law, in no event will either party be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost revenue, lost data, or business interruption arising out of or related to these Terms, even if advised of the possibility. Each party’s total cumulative liability arising out of or related to these Terms is capped at the amount you paid Kustiq in the twelve months immediately preceding the event giving rise to the claim. Nothing in this section limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.

§15Indemnification

Plain EnglishWe cover claims that the platform itself infringes someone else’s IP. You cover claims that come from how your team uses the output (sending the message, importing the list).

By Kustiq. We will defend you against any third-party claim that the Service, used as permitted under these Terms, infringes a valid third-party intellectual-property right, and will pay damages finally awarded against you for that claim.

By you. You will defend Kustiq against any third-party claim arising from your use of generated output, your contact lists, or your acts or omissions that breach these Terms or applicable law (including spam, marketing-consent, or sanctions regulations), and will pay damages finally awarded against Kustiq for that claim.

Either party’s indemnity is conditional on the indemnified party giving prompt notice, allowing the indemnifying party to control the defence and any settlement, and providing reasonable cooperation.

§16Termination

Plain EnglishYou can cancel anytime. We can suspend for non-payment or breach. After deletion you have 30 days to export, then your data is removed under the erasure runbook.

By you. Cancel any time from Billing. Cancellation drops the account to free-plan access at the end of the current billing period.

By us. We may suspend or terminate access for non-payment after the failed-payment retry window described in §5, for material breach of §8 (Acceptable use), or where required by law or sanctions. Where the breach is curable, we will give written notice and a 14-day cure period.

After termination. You have 30 days from the effective termination date to export everything from Billing → Export. After 30 days your account, customer data, and OAuth tokens are deleted under our GDPR Article 17 erasure runbook; aggregated, anonymised data may persist for product improvement, as described in §11. Email addresses you marked as suppressed remain on the global suppression list indefinitely; this is the lawful basis for honouring opt-outs and is exempt from erasure under GDPR Art 17(3)(b).

§17Changes to these terms

We may update these Terms from time to time. Material changes are announced by email to the billing contact on file at least 30 days before they take effect. Non-material changes (typo fixes, link updates, sub-processor list refresh) take effect on publication. The effective version is always the one published at kustiq.com/terms; the version history is in the disclosure at the top of this page. Pricing changes are governed separately by §5a.

§18Force majeure

Neither party is liable for failure or delay caused by events beyond reasonable control, including acts of God, war, terrorism, civil unrest, government action, network or power outages, epidemics, or sub-processor failures whose root cause was beyond the sub-processor’s reasonable control. The affected party will give prompt notice and use commercially reasonable efforts to resume performance.

§19Dispute resolution

The parties will first attempt to resolve any dispute informally by emailing support@kustiq.com. Both sides will discuss in good faith for at least 30 days before starting formal proceedings.

Default forum. If informal resolution fails, the dispute is subject to the exclusive jurisdiction of the courts of Bucharest, Romania, as set out in §20.

Optional arbitration for US enterprise.Where the customer is a legal entity domiciled in the United States, either party may instead elect, by notice in writing within 60 days of the failed informal resolution, to submit the dispute to binding arbitration administered by JAMS under its Comprehensive Arbitration Rules in effect at the time. The seat is New York, NY. The arbitral award is final, binding, and enforceable in any court of competent jurisdiction. This option does not limit either party’s right to seek injunctive relief in any court.

§20Governing law

Plain EnglishRomanian law applies. The default forum is Bucharest courts. US enterprise customers can opt into JAMS arbitration in New York under §19.

These Terms are governed by the laws of Romania, without regard to its conflict-of-laws principles. Subject to §19, the courts of Bucharest, Romania, have exclusive jurisdiction over any dispute. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

§21General provisions

Entire agreement. These Terms, the Privacy Policy, and the DPA constitute the entire agreement and supersede all prior agreements on the same subject.

Severability. If any provision is held unenforceable, the remainder remains in effect, and the unenforceable provision will be reformed to the minimum extent needed to make it enforceable.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of substantially all assets.

No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.

Notices. Notices to Kustiq go to support@kustiq.com. Notices to you go to the billing email on file.

FAQFor procurement

Does Kustiq offer refunds?
Subscriptions are non-refundable for the current billing period. Annual plans are refundable pro-rata within 14 days of activation if the workspace has consumed less than 10% of its credit allowance. One-time credit packs are non-refundable once any credit in the pack has been consumed. Full text in §5.
Do Kustiq credits expire?
Subscription credits expire at the end of each billing cycle and do not roll over. One-time top-up credit packs remain usable for 12 months from purchase. There is no per-credit charge once a credit is allocated; usage is accounted phase-by-phase. Full text in §5.
Who owns the data Kustiq generates about my prospects?
The Customer owns the output profiles, qualification scores, and outreach drafts produced inside its workspace. Kustiq retains no IP claim over output content and grants the Customer a perpetual, irrevocable licence to use the output for any lawful business purpose. The underlying pipeline, prompts, and software remain Kustiq IP. Full text in §11.
Can I resell Kustiq output or build a competing product?
Output (profiles, qualification scores, outreach drafts) may be used inside the Customer's business and shared with the Customer's own clients with attribution. Reselling raw API access to third parties, or using Kustiq output to train a competing AI research or prospecting product, is prohibited. Full text in §8 and §11.
What law governs the Terms and where are disputes heard?
The Terms are governed by Romanian law. Disputes are heard in the courts of Bucharest, Romania. EU consumers retain the protection of mandatory provisions of their local law and the right to file complaints with their local consumer-protection authority. There is no mandatory arbitration clause. Full text in §19 and §20.
Is Kustiq usage subject to acceptable-use limits?
Scraping LinkedIn, Apollo, or other vendor properties through Kustiq endpoints is prohibited. PII enrichment of non-business contacts (consumers, minors, sanctioned individuals) is prohibited. Bulk credential stuffing and competitive-intelligence harvesting against Kustiq itself are prohibited. Full acceptable-use policy in §8.
How do I cancel and what happens to remaining credits?
Cancel self-serve from /dashboard/billing at any time. Cancellation takes effect at the end of the current billing cycle. Unused subscription credits forfeit at cycle end. Unused top-up credits remain usable for 12 months from purchase, even after subscription cancellation. Workspace data export is available for 30 days post-cancellation. Full text in §16.
