Terms of Service

Kustiq uses a credit-based billing model, generates AI-powered company profiles from public web data, and is operated by Analytics Lab S.R.L. (Romania). These terms cover billing, acceptable use, AI content accuracy, data ownership, and liability. Our Privacy Policy and Data Processing Agreement also apply.
1. Agreement
By accessing or using Kustiq (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.
Kustiq is operated by Analytics Lab S.R.L. (CUI: RO50212590, Reg: J2024011530406), with its registered office at Int. Gheorghe Simionescu 19, 014155 Sector 1, Bucharest, Romania.
These Terms, together with the Privacy Policy and Data Processing Agreement, form the complete agreement between you and Analytics Lab S.R.L. regarding the Service.
2. Service description
Kustiq is a company intelligence platform for B2B teams. It generates company profiles from publicly available web data and includes an outreach pipeline, churn risk scoring, churn prediction, and related features accessible through the web application and API.
We target 99.9% uptime for the web application and API but do not guarantee uninterrupted access. Planned maintenance windows are communicated via email or the application when possible. We are not liable for temporary unavailability due to maintenance, third-party service disruptions, or circumstances beyond our control.
3. Accounts and teams
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately at support@kustiq.com if you suspect unauthorized access.
If you create an organization or invite team members, the organization owner is responsible for all activity by team members within the organization, ensuring team members comply with these Terms, and managing permissions using the role-based access controls provided. Billing is at the organization level and the organization owner or billing admin is responsible for all charges incurred, regardless of which team member initiated the usage.
4. Credit-based billing
In plain terms: your plan includes monthly credits that reset each cycle. Extra credits you buy separately never expire. You can cancel anytime.
- Paid plans include a monthly credit allocation. Credits reset at the start of each billing cycle. Unused monthly credits do not roll over.
- Extra credits can be purchased at any time at the rates shown on our pricing page. Extra credits do not expire and persist across billing cycles until used.
- Each profiling request consumes credits based on the processing tier selected: Economy (0.33 credits, faster), Standard (1 credit, balanced), or Premium (2 credits, maximum depth).
- Subscriptions are billed monthly or annually through Stripe. Upgrades take effect immediately with prorated charges. Downgrades take effect at the end of the current billing period.
- You may cancel your subscription at any time. Your plan remains active until the end of the current billing period.
- Refunds: subscription fees are non-refundable except where required by applicable law. If you cancel mid-cycle, your access continues through the end of your paid period. Extra credit purchases are non-refundable once credits have been delivered to your account. If a technical error on our side prevents credit delivery or a job fails before completion, we will either deliver the credits or refund them to your balance.
- Failed payments:if a subscription payment fails, we will retry the charge up to 3 times over a 7-day period using Stripe’s automatic retry logic. During the retry period, your subscription remains active. If all retries fail, your account will revert to free plan access until payment is resolved. We will notify you via email before any access restriction takes effect. Extra credits already purchased remain available regardless of subscription status.
5. Free plan
The free plan provides 3 credits per week with no time limit and no credit card required. Free plan usage is rate-limited per IP address. We reserve the right to modify or discontinue the free plan at any time. Free plan users can upgrade to a paid plan at any time to access higher credit allocations and additional features.
6. AI-generated content
Profiles are AI-generated from public web data. They are informational, not verified facts. Always validate before making business decisions.
Company profiles and intelligence generated by Kustiq are produced using a combination of deterministic data pipelines and AI language models. We invest in accuracy engineering and provide confidence scores so you can assess data quality. However, as with any intelligence product, profiles may reflect conditions at the time of processing and should be used alongside your team’s judgment.
You acknowledge that:
- Generated profiles are not verified facts and should be treated as a starting point for further research.
- Profiles are generated from publicly available web data at the time of processing and may not reflect current conditions.
- Confidence scores indicate the engine’s assessment of data quality, not a guarantee of accuracy.
AI model training: your data is not used to train AI models. Data submitted to the Service is processed via Anthropic’s API, which contractually prohibits the use of API inputs and outputs for model training. We do not use your data to fine-tune, train, or improve any AI model. Learn more about our data practices on our Trust & Security page.
7. Acceptable use
Kustiq provides an API and web application designed for programmatic access and integration. Automated use through our documented API is encouraged. You agree not to:
- Use the Service to send unsolicited bulk messages or any communication that violates applicable anti-spam laws (such as CAN-SPAM or GDPR).
- Attempt to reverse-engineer, decompile, or extract the underlying models or algorithms.
- Resell or redistribute generated profiles as a standalone data product without authorization.
- Use automated scripts outside the documented API to abuse the Service or circumvent rate limits.
- Submit data you do not have the right to process.
- Use the Service to build, train, or populate a product or service that competes with Kustiq, or to systematically download or store generated profiles for the purpose of creating an alternative database.
8. API access
API access is available on eligible plans. By using the Kustiq API, you agree to the following additional terms:
- API keys are confidential. You are responsible for all activity under your API keys. Compromised keys must be rotated immediately.
- Rate limits are published in our API documentation. We may throttle or suspend access if you exceed published limits or if your usage degrades the Service for other customers.
- API output is subject to the same intellectual property and acceptable use terms as the web application.
- We may modify, deprecate, or discontinue API endpoints with 30 days’ notice. Breaking changes will be communicated via email.
- Automated bulk redistribution of API output to third parties is prohibited without prior written authorization.
9. Third-party integrations
The Service offers integrations with third-party platforms (e.g., HubSpot CRM). When you enable an integration:
- You authorize Kustiq to access and synchronize data between the Service and the connected platform in accordance with the permissions you grant.
- The third-party platform’s own terms of service and privacy policy also apply to your use of that platform.
- We are not liable for data loss, corruption, or access issues caused by changes to the third-party platform’s API or service.
- You may revoke integration access at any time from your account settings.
10. Intellectual property and data ownership
Platform: the Kustiq platform, including its software, algorithms, models, user interface design, and branding, is the exclusive intellectual property of Analytics Lab S.R.L. All rights not expressly granted are reserved.
Your data: you retain all rights to the data you submit to the Service. We do not claim ownership of your input data.
Generated profiles: Kustiq grants you a non-exclusive, non-transferable license to use generated profiles for your business purposes, including sharing with your clients in the ordinary course of your business (e.g., in reports, presentations, or internal analyses). You may not resell generated profiles as a standalone data product or use them to build a competing service.
Aggregated data: we may use anonymized, aggregated data derived from Service usage to improve the Service, develop new features, and produce industry benchmarks. Such data will never identify you, your organization, or any individual company you have profiled.
Data never sold: we do not sell, rent, or share your data with third parties. Kustiq generates revenue exclusively from subscriptions and credits. See our Privacy Policy for full details on data handling and your rights.
11. Confidentiality
Each party agrees not to disclose the other party’s Confidential Information to any third party without prior written consent. “Confidential Information” means information designated as confidential or that a reasonable person would understand to be confidential, including API keys, billing terms, account configurations, and proprietary business data.
This obligation does not apply to information that is: (a) publicly available through no fault of the receiving party; (b) independently developed; (c) rightfully obtained from a third party; or (d) required to be disclosed by law.
12. Disclaimer of warranties
In plain terms: we stand behind the service, but we cannot guarantee it will be perfect at all times.
The Service is provided “as is” and “as available.” To the maximum extent permitted by applicable law, Analytics Lab S.R.L. disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated outputs. We do not warrant that the Service will be uninterrupted, error-free, or that generated profiles are complete, current, or suitable for any specific business decision.
13. Limitation of liability
In plain terms: our financial liability is capped at what you paid us in the last 12 months. We are not liable for indirect losses.
To the maximum extent permitted by law, Analytics Lab S.R.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.
Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Analytics Lab S.R.L., its officers, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms or applicable law; (b) data you submit to the Service that you did not have the right to process; (c) your violation of any third party’s rights using outputs from the Service.
We will promptly notify you of any such claim and cooperate in your defense.
15. Termination
We may suspend or terminate your account if you violate these Terms, including the acceptable use rules in Section 7. You may delete your account at any time through your account settings or by contacting support@kustiq.com.
Upon termination, your right to use the Service ceases immediately. You may export your profile data and account data at any time through the dashboard export feature. After cancellation, you will have 30 days to export your data before deletion. Data deletion follows the timeline described in our Privacy Policy and Data Processing Agreement.
The following sections survive termination: Intellectual Property and Data Ownership, Confidentiality, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.
16. Changes to these terms
We may update these terms from time to time. For material changes, we will notify you by email at least 30 days before the changes take effect. Non-material changes (e.g., formatting, clarifications) may be posted without advance notice. Continued use of the Service after changes take effect constitutes acceptance of the updated terms. If you do not agree with a material change, you may cancel your subscription before the change takes effect.
17. Force majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including natural disasters, acts of government, pandemics, internet or telecommunications failures, or failures of third-party infrastructure providers. The affected party shall promptly notify the other party and make reasonable efforts to mitigate the impact.
18. Dispute resolution
Before initiating any legal proceedings, both parties agree to attempt to resolve the dispute through good-faith negotiation for a period of 30 days after written notice. If the dispute is not resolved informally, either party may proceed with formal proceedings as described in Section 19.
19. Governing law
Romanian law applies. For customers in the EU, this is standard. For customers outside the EU, any legal proceedings would take place in Romania.
These terms are governed by and construed in accordance with the laws of Romania. Any disputes arising from or relating to these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania. For customers in the European Economic Area, nothing in these terms affects your rights under GDPR or other mandatory protections of your country of residence.
20. General provisions
- Severability: if any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.
- Entire agreement: these Terms, together with the Privacy Policy and Data Processing Agreement, constitute the entire agreement between you and Analytics Lab S.R.L. regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
- Assignment: you may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
